The Office of the Attorney General of the Nation charged with animal abuse Myriam Patricia Heredia, owner of a dog named Luna, was found in an advanced state of malnutrition and in condition of neglect.
According to the information provided by the Prosecutor's Office, the case was registered on November 17, 2018, when the District Institute for Animal Protection and Welfare (IDPYBA) carried out an inspection visit to a house in Engativá and found Luna in poor nutritional and health conditions and with obvious alterations in behavior.
“For the crime of animal abuse, Miryam Patricia Heredia was charged, who apparently kept a dog named Luna in terrible conditions of care on the terrace of a house in Engativá. During an inspection visit, the authorities found Luna in a high state of malnutrition and with obvious signs of lack of attention from her caregivers,” said Alejandro Gaviria.
In addition, the Prosecutor's Office reported that the animal was taken to a veterinary care center where it was detected internal bleeding that had not been treated in a timely manner and, given the seriousness of its condition, the veterinary specialists euthanized it.
There are many cases of animal abuse, which is why the Institute for Animal Protection (IDPYBA), calls on citizens to report cases of abuse of animals and not be indifferent to their suffering.
In addition, through the line 018000115161, they may contact an operator to report a situation of abuse and provide the information they have, together with personal contact details, which will be processed under the existing confidentiality policies.
Likewise, animals, whether domestic or wild, are subject to violations of their rights in Colombia. Faced with this, those who perpetrate these attacks are subjected by the Attorney General's Office to multiple legal consequences that discourage the practice.
It is noteworthy that Law 1774 of January 6, 2016 regulates the subject. This regulation guarantees that the attitude between humans and animals is based on “respect, solidarity, compassion, ethics, justice, care, the prevention of suffering, on the eradication of captivity and abandonment”, the document cites.
On the other hand, the well-being of living beings lies, in turn, in that their holder must comply with five minimum principles: that they should not suffer from hunger, thirst, physical discomfort or pain; that they are not caused by negligence or carelessness, that they are not subjected to fear or stress and that they can manifest their natural behavior.
According to article 4 of the Act, those who commit harmful acts that do not result in death or injury to the health and physical integrity of animals shall be punished by a fine of 5 to 50 statutory minimum monthly wages in force.
On the other hand, those who cause death or injury that seriously impair the health or physical integrity of the animal may face imprisonment between 12 and 36 months. In addition, they would face special disability of one to three years for the exercise of profession, trade, trade or possession related to animals.
In the face of fines, those who cause the damage described above must pay between 4,542,630 pesos and up to 54,511,560 pesos.
Even these would be increased from half to three quarters if they were committed with the following aggravations:
- Sevicia.
- When one or more of the above-mentioned behaviors are perpetrated on a public road or place.
- Using imputable persons or minors or in the presence of them.
- When sexual acts are committed with animals.
- When any of the offences provided for in the preceding articles is committed by a public servant or who performs public functions.
