In the last few minutes it became known that the JEP Review Section admitted for study a guardianship presented by a group of victims represented by the Inter-Church Commission for Justice and Peace, in which they request that the judgment refusing their submission to the court, submitted as a “civil third party”, be revoked.
According to information from W Radio, according to the victims' arguments, on March 25 of this year the Definition Chamber announced that it had refused to take alias Otoniel into transitional justice, without being allowed to intervene in the decision taken, much less controversial it.
Faced with this, the victims ask to overthrow the ruling alleging violation of due process.
Excerpts of the guardianship revealed by the station show that, according to the victims, “none of the requests submitted to the Chamber have been met, despite the urgency of the situation and the imminent irreparable damage to the rights of the victims, since Mr. Dairo Antonio Úsuga David, a potential subject of competence of this jurisdiction, is on the verge of being extradited to the United States”.
It is worth recalling that in recent hours the JEP refused to suspend the extradition of the former Gulf Clan commander, as requested by the victims in that judicial action, since, according to the ruling, refusal to submit has nothing to do with extradition.
Therefore, the Definition Chamber would not have the power to issue a concept on the subject, with the Supreme Court of Justice being solely responsible for deciding on the matter, since alias Otoniel is not currently under the jurisdiction of the JEP.
“... to adopt a measure aimed at denying or “prohibiting” the extradition of Mr. Dairo Antonio Úsuga David, alias Otoniel, would imply usurping the powers of judicial and administrative authorities legally empowered to study and rule on such matters in substance,” the Section concluded.
It is worth recalling that on April 7, the group of victims “We are Genesis” said in a statement that the extradition of the former head of the Gulf Clan is a blow to the reparation of the people affected by this paramilitary group
In the statement, the victims' organization stated that there were many occasions when it tried to stop the trial against the paramilitary chief.
Members of the organization “Somos Genesis” traveled from Urabá to Bogotá to commemorate the day of the victims on April 9, they said that when they arrived in the capital of the Republic, they found the news of the high court.
“We came because our writings seem to be insufficient, to see if our words make sense of so many laws, treaties, procedures, what they call jurisprudence, that seem like hard walls that impede truth and justice, for our lives and our territories,” they said.
In other paragraphs of the communiqué, the victims point out that the role of the Special Jurisdiction for Peace (JEP) will be essential to prevent the extradition of the Gulf Clan kingpin. “The JEP should not appeal to the Supreme Court of Justice, it should condition and request the suspension of Otoniel's extradition until justice is done here. No revenge either with Otoniel, nor with the military, nor police, nor businessmen, nor politicians or perhaps the justice apparatus who are involved in the process.
