Resolution 539 of 2022, signed by the Ministries of Justice, Agriculture and Trade, was issued, regulating foreign trade operations in seeds for sowing, grain, plant component, cannabis plants, cannabis, cannabis derivatives and related products.
In this way, those interested in importing seeds for sowing, grain, vegetable component, cannabis and derivatives thereof, will have to go through an application process to be granted a licence to import and enter the free zones in the Single Window for Foreign Trade (Vuce), where the authorities competent authorities will have to render their verdict based on Decree 925 of 2013.
One of the entities responsible for providing the authorization is the Colombian Agricultural Institute, to which the current registration as a seed importer or as a Plant Breeding Research Unit must be accredited, but it must also have the technical specifications regarding THC content and the Certificate Phytosanitary for Nationalization.

Another approval must come from the Subdirectorate for Control and Control of Chemicals and Narcotic Drugs of the Ministry of Justice and Law, to which the respective license must be presented, the indications of the use to be given to the imported goods, the indication of the area and the real estate registration number where the activity and the amount of material to be received will be advanced.
In the case of vegetable components, they must have prior authorization from the ICA and the National Institute for Drug and Food Surveillance (Invima), to which the licence to manufacture non-psychoactive derivatives, the manufacturing quota and the destination of the final product must be accredited.
In the case of exports, traders will have to take the authorised application to the Vuce, where the “approval” will be processed before the respective authorities. Procedures must also be made with the Foreign Trade Directorate of the Ministry of Commerce, Industry and Tourism.
It should be said that in the case of marketing for scientific purposes without registration in the National Register of Commercial Cultivars (RNCC), cultivars that are not registered in the ICA system may be exported only when they have been a product of guaranteed genetic improvement and the objective of export is intended scientists”.
But if it is only cannabis, “export to the rest of the world for medical and scientific purposes will be facilitated by authorized persons and with the approval of the respective entities”.

We are very proud to be one of the first to successfully complete a Colombian high manufacturing commercial shipment of CBD to Germany,” confirmed the global president and next CEO of Clever Leaves Holding, Andrés Fajardo.
The company also assured that this would be the first commercial shipment of cannabis products manufactured in Colombia and with GMP (good manufacturing practices) certification from the European Union, which will be marketed in German pharmacies.
