Release of former paramilitary alias' Huevoepizca 'revoked in Jineth Bedoya

In recent hours it became known that the Criminal Chamber of the Supreme Court of Justice overturned the suspension of the 40-year prison sentence of former paramilitary Jesús Emiro Pereira Rivera, alias Huevoepizca, convicted in 2019 for the case of journalist Jineth Bedoya.

For the Court “it is a contradiction that it benefits from what is proven by the ordinary justice system while denying it in Justice and Peace” and also noted that Pereira Rivera “does not meet the conditions to have this benefit of the Justice and Peace process on the demobilization of paramilitaries”.

He added that this is “contrary to what was admitted in the first instance decision, the postulate has not recognized his proven co-author status in the crimes perpetrated against the communicator, refusing the truth declared judicially in 2019″.

The thesis of the judges of the Criminal Chamber is that alias Huevoepizca has admitted to Justice and Peace to know the occurrence of these events, but denies that he was one of their perpetrators or had an impact on the order for their execution.

Thus, in the position of the demobilized person, he does not know the sentence ratified in two instances by the ordinary justice system, in which it is concluded that the deplorable, cruel and painful acts judicialized were committed by the paramilitary organization of which Pereira Rivera was a member as financial commander (Self-Defense and Bloc) Centauros) and liaison of groups operating in Bogotá and the Eastern Plains.

Despite the ruling of the ordinary jurisdiction, the former member of the demobilized self-defence groups has admitted to Justice and Peace to know the occurrence of these events, but denies that he was one of their perpetrators or had an impact on the order for their execution.

This situation shows a contradiction “between the two propositions, which does not allow us to assume that this event will be summoned to accumulate in the eventual judgment handed down against Pereira Rivera in the seat of transitional justice, since from the perspective of the postulate it is not an act that he committed during and during the conflict”, he emphasizes the pronouncement of the Court.

“In order for the benefit to be effective, it must be established that the crime that gave rise to the conviction by the ordinary courts was committed during the time of the sentenced person's membership of the armed group and on the occasion of this association, an assumption that he rejects”, underlines the decision.

In a statement, on December 16, 2021, the Attorney General's Office announced the accusation against the dragonman of the National Penitentiary and Prison Institute (INPEC), Marco Javier Morantes Pico, as allegedly responsible for the crime of simple aggravated kidnapping, in relation to the violent acts against the journalist Jineth Bedoya Lima, which occurred on 25 May 2000.

The indictment against Marco Javier Morantes Pico confirms that despite the fact that the measure is not custodial, it is the responsibility of Migration Colombia and other authorities to ensure that this man does not leave the country, in order to meet the judicial requests that are issued.

Similarly, it is reported that after 21 years of the crimes against the communicator, the process is followed in accordance with the guidelines defined in Law 600 of 2000 (formerly Penal System).
